Clay County Sheriff Vic Davis said on Saturday 4/23/2016, Clay County Sheriff’s deputies responded to 66 George Sorrels Road in Hayesville in reference to a disturbance. Upon arrival, they encountered a female who had obvious lacerations to her body and was bleeding heavily. They also encountered a male who sustained lacerations to his hand. Deputies secured the scene so that EMS could tend to the injured. Both the male and the female where flown out by helicopter to have their injuries treated. Sheriff’s investigators, as well as investigators with the State Bureau of Investigations (SBI), responded to the scene to collect evidence and further process the crime scene. Sheriff Davis said on Monday, April 25, 2016, investigators have charged Alejandro Huerta Aguilar with Felony B&E, Felony theft of a Firearm, and two counts of Assault with a Deadly Weapon with Intent to Kill Inflicting Serious Injury. He is currently being held at the Clay County Detention Center under a $200,000 secured bond. His next court date is May 9th. This incident is still under investigation. An ongoing investigation by the North Carolina State Bureau of Investigation and DEA Drug Diversion Task Force has led law enforcement to Hayesville Family Practice in Clay County, North Carolina. Hayesville Family Practice is owned and operated by Union General Hospital in Union County, Georgia. On April 20th, 2016, multiple agents of the NC SBI and DEA Drug Diversion Task Force, along with Clay and Cherokee County Sheriff's Office investigators, executed a search warrant. Family Nurse Practitioner (FNP), Keith Plott, was named in the search warrant and as a result, he was interviewed on scene at the time the search warrant was executed. According to the search warrant affidavit, the investigation stems from concerns over prescription medications. Numerous patient records, along with other files and records identified as being potential evidence, were seized. The District Attorney’s Office will be reviewing the findings of the search warrant and will make a determination as to possible charges. Murphy, NC— Sheriff Derrick Palmer announced the April 17th, 2016 arrest of 38-year-old Charles V Shannon, of Marble, North Carolina, 42-year-old Eric Scott Turner, and 43-year-old Kevin Thomas Coleman, both of Murphy, North Carolina for the illegal possession of controlled substances. Shortly after midnight on April 17th, 2016, a Cherokee County deputy observed a vehicle on Old Ranger Road in Murphy, North Carolina. The deputy observed a traffic violation and made a traffic stop of the vehicle in which the occupants were identified as Shannon, Turner and Coleman. During the traffic stop, a wants and warrant check revealed that Shannon had warrants for his arrest. During a search of the vehicle incident to arrest a substantial amount of methamphetamine was found in the vehicle. Shannon, Turner and Coleman were arrested and taken to the Cherokee County Detention Center. Shannon was charged with: BREAKING AND OR ENTERING, LARCENY AFTER BREAK/ENTER, TRUE BILL OF INDICTMENT, FAILURE TO APPEAR ON FELONY, POSSESS DRUG PARAPHERNALIA, POSSESS METHAMPHETAMINE. Shannon was set a $95,000.00 secure bond and is currently in the custody of the Cherokee County Detention Center and is expected to appear in Cherokee County District Court on May 16th, 2016. Turner and Coleman were charged with: POSSESS DRUG PARAPHERNALIA, POSSESS METHAMPHETAMINE. Both were released on a $2,000.00 secure bond each and both are scheduled to appear on April 27th, 2016. Murphy, NC— Sheriff Derrick Palmer announced the April 12th, 2016 arrest of Chad Antonio Mayner, a 28-year-old Murphy, North Carolina man for charges involving possessing and selling drugs. Cherokee County Sheriff’s Narcotics Investigators observed what they believed to be the sale of marijuana by Mayner near his residence. Upon further investigation, it became known that Mayner had sold an amount of marijuana to two individuals. During a subsequent knock and talk conducted at Mayner’s Murphy, North Carolina residence, investigators found an additional quantity of marijuana, a handgun, liquid codeine, scales and other paraphernalia which were seized. Additional charges are anticipated. Mayner was arrested and charged for: SELL/DELIVER MARIJUANA, AID AND ABET MAINTAIN A DWELLING, MAINTAIN PLACE CONTROLLED SUBSTANCE, POSSESS DRUG PARAPHERNALIA, POSSESS WITH INTENT TO MANUFACTURE/SELL/DELIVER MARIJUANA, POSSESS SCHEDULE II CONTROLLED SUBSTANCE, SIMPLE POSSESSION SCHEDULE II CONTROLLED SUBSTANCE, MANUFACTURE/SELL/DELIVER/POSSSESS CONTROLLED SUBSTANCE WITHIN 1000 FT OF SCHOOL. Mayner is currently confined in the Cherokee County Detention Center under a $25,000.00 secure bond awaiting a May 5th, 2016 District Court date. Murphy, NC— Sheriff Derrick Palmer announced the April 8th, 2016 arrest of 53-year-old Dale Hamilton Dutto of Cartersville, Georgia and 45-year-old Carla Blair Lloyd of Murphy, North Carolina for controlled substance violations. On or about April 8th, 2016, Narcotics Investigators with the Cherokee County Sheriff’s Investigations Division conducted a traffic stop on a vehicle that was occupied by Dutto and Lloyd for a motor vehicle violation. During the traffic stop, the Sheriff’s Office K9 alerted to the presence of controlled substance which were believed to be in the vehicle. A subsequent search of the vehicle located trafficking amount of a substance believed to be Methamphetamine and quantity of marijuana was also seized from the vehicle. Dutto and Lloyd were arrested and brought to the Cherokee County Detention Center where they were charged with: TRAFFIC IN METHAMPHETAMINE, MANUF/SELL/DEL SCHEDULE II CONTROLLED SUBSTANCE, MAINTAIN PLACE CONTROLLED SUBSTANCE, POSSESS DRUG PARAPHERNALIA, POSS W/I, SIMPLE POSSESS SCH VI C/S. Dutto and Lloyd are currently being held on a $200,000.00 secure bond awaiting a April 27th, 2016 District Court date. Murphy, NC— Sheriff Derrick Palmer announced the April 08th, 2016 arrest of 30-year-old Seth Michael Tate, of Murphy, North Carolina and 37-year-old Noah Emmanuel Metro of Andrews, North Carolina for violations of the sex offender registry.
On or about April 4th, 2016, Patrol Deputies and Investigators were conducting Sex Offender verification checks in Cherokee County. Information had been made known that both Tate and Metro were in violations of the provisions of the sex offender registry and were arrested on warrants. Information collected during the registration process indicated that Tate registered for an out of state conviction involving a child under 12. Tate was arrested at the Cherokee County Sheriff’s Office and later made secure $20,000 bond awaiting a April 27th, 2016 District Court date. Information collected during the registration process indicated that Metro registered for an sex offense in 2000 involving children under the age of 12. Metro was arrested at his Andrews, North Carolina residence. Metro is currently being held at the Cherokee County Detention Center under a $20,000 secure bond awaiting a April 27th, 2016 District Court date. Technical or not the laws and procedures to monitor sex offenders are clear and these individuals are aware of their duties and requirements. The authorization allows the landowners, at their own expense, to reconstruct and repair portions of Phillips Ridge Road (Forest Service Road 340A1) and construct approximately one-third mile of new road on NFS land to access their 50-acre tract of private property located within the Fires Creek watershed near Hayesville, NC. Federal regulations require the Forest Service to allow access to private property that is surrounded by NFS land so the landowner may experience "reasonable use and enjoyment" of their property (36 CFR 251.54). Regulations also require the landowner to exhaust all alternatives means of access through private property or other rights-of-way before approving access across public land. "While allowing access to private property, we want to ensure that there are no unforeseen environmental impacts," said Allen Nicholas, Forest Supervisor for the National Forests in North Carolina. "We recognize this area is highly valued for its recreation opportunities and outstanding resource waters so we have added measures designed to protect the Fires Creek watershed." In June 2015, the Forest Service released a draft decision and environmental assessment (EA) that analyzed and disclosed the effects that could result from providing access to the private property across NFS land. The EA considered effects related to water quality, acidic rock, biological resources (including fisheries, botanical resources, wildlife habitat, forest communities, special habitats, management indicator species) scenery, recreation, heritage and cultural resources, and other issues. As part of the analysis, the Forest Service considered comments from individual citizens and a wide variety of organizations concerning the project. Twelve objections to the project were received in response to the draft decision and EA, one of which has been resolved and withdrawn. In response to the issues raised in the objections, the final decision clarified and enhanced the design criteria. These changes provide additional measures for ensuring protection of water quality and avoiding and minimizing disturbance of acid-producing rock. Allen was on routine patrol checking various residences on Blair Lane in Murphy. Residents in the area had been advising the Murphy Police Department of suspicious activity and increased motor vehicle traffic. During this time, Patrol Officer Allen was able to locate a pickup truck that had been stolen out of Hiwassee, GA. At this time, Patrol Officer Clint E. Wooten and Assistant Chief Dustin D. Smith responded to the area to assist. Upon subsequent investigation, Mr. Harkins was found hiding inside the home. Mr. Harkins, who had multiple warrants for arrest for various charges, was then placed under arrest. Ms. Lloyd, who owns the residence, and Ms. Welborn, who resides there as well, were then placed under arrest for their charges. The stolen vehicle was then returned to the owner and investigating agency in Hiwassee, GA. Ms. Lloyd's charges are as follows: Harboring a Fugitive Possession of a Stolen Vehicle Ms. Lloyd's bond is currently set at $2,000.00 secured. She has an initial court date of April 13th, 2016, at 09:00 am. Ms. Welborn's charges are as follows: Harboring a Fugitive Possession of a Stolen Vehicle Ms. Welborn's bond is currently set at $5,000.00 secured. She has an initial court date of April 13th, 2016, at 09:00 am. Mr. Harkins charges are as follows: Failure to Appear on a Felony (3 Counts) Possession of a Stolen Vehicle Resisting Public Officer Mr. Harkins bond is currently set at $36,000.00 secured.
